Hi,
I'm in H1b since March 2006 and it Expired in March 2009. Got extension Until Sept 2009 Only (as per RFE and client information).
( I'm about to deliver a baby in Oct 2009, so I need to be in the country atleast until Dec 2009)
1) If my further extension were to be denied (touch wood), say that decision was made by USCIS in Nov 2009,
Can I do COS ( change of status) to F2 or B2 visitor once I came to know about the denial?
or
Do I need to initiate a COS when the case is pending?
or
Do I need to initiate a COS when I have a valid status, say in Aug 2009 itself?
2) Assuming, I do COS successfully from H1b to F1 ( say in Oct 2009)
Then, in Feb 2010 would I be able to get back to H1 again with the same or different employer? without needing to wait for Apr 2010 quota to open?
3) Also, when a H1b is denied does it mean that the person has to wait to get into another cap? or
can they still apply for H1b year round as they are already counted in Cap sometime before?

How come a govt. organization that is never known to do things on time, all of sudden is able to approve 60000 GCs in such a short period ? Why did they have to do it by end of June ? If they had done that by end of July would anything have been different for the folks who were getting the Green Cards - NO.
I think this was all planned. There was a reason why the numbers were made current and there is a reason why the numbers became unavailable.
I think we should get to the bottom of this. This stinks ......

I have an approved I-140 and have a pending I-485 filed with NSC, received date 15 Aug 07. NSC I-485 processing date was moved up to Aug 15 a few days ago.
Was wondering if anyone else with similar received dates got an approval or some form of reply from NSC?

Trying to help Mother-In-Law over from China for visit. Unsuccessful w/ tourist Visa process, so now going for Green Card. Received Notice of Decision against me, unable to establish my Petitioner wife is daughter of Beneficiary Mother-In-Law. No hospital records. Previous evidence was "Notarial Certificate of Relationship." I have just received new evidence "Notarial Certificate of Birth" from civil authorities - along with affidavit from school teacher - I need to file EOIR-29, I think to call it APPEAL, OR IN THE ALTERNATIVE, MOTION TO RECONSIDER - can anyone provide a "go-by" as to what format my letter should take? Is letter format acceptable or is formal pleading format needed?
Time is of the essence, I have to file within 24 hours or give up and pursue DNA testing....

If one has Green Card based on family preference (son of US citizen), how long he has to stay in USA to maintain his Green Card. I heard it is min 180 days in a year ? Is that correct ?
What are other restrictions ? Does it impact citizeship ?
A detailed answer would be very helpful.
Also If one has Green Card which one if faster router to get his spouse to USA:
1. Applying as daughter in law of US Citizens. Or
(what family preference catergory this is ?)
2. Applying as wife of person having Green Card

I filed for 485 duing July . and i filed for EAD in Nov via e-file. in first week of Nov i got FP notice for 485 and i resheduled it and they gave me a slot in first week of dec acceptable to me. in third week that is on saturday 11/17 i got FP notice for my e-filed EAD a date in last week of Nov which again i cant attend. Now i went to ASC on saturday and i met the supervisor and told her can i do both FP's on same day . She looked at those forms and corrected the Appointment notice of EAD manually to date i want and signed on it. she said that should be OK and no issues for that. She told me multiple time and also gave me forms to be filled to save time on that day . Any issues ?

Please let me know if 140 processing times is based on receipt date or notice date?
I'm a concurrent 140-485 filer, filed on July 2 2007. My notice date on I-140 says August 16, 2007, where as my friend who filed only140 on july 2 has Notice date of july 12. Does that mean his will be processed first?

I'm a little confused about my options in starting my H1 extension process and applying for my wife's H4 application.
Here is my current status :
6 yr H1-B period is ending on Dec 22, 2009. I'm getting married in India in October and will apply for my wife's H4 immediately after. Here are my questions :
1. Will there be any problem with my wife's H4 application if there are just 2 months of validity left on my H1 visa?
2. I could potentially start my H1 extension process now. I'm eligible for a 3 year extension since the Priority date of Jan 3, 2006, on my EB2 application is not current. If I was to start my extension process now, my approval may not happen before October and my lawyer there may be some problems if I travel outside the country on a pending H1 application. Should I apply for my H1 extension now or after I come back to the US in November?
3. If I was to apply for H1 extension in Nov and don't get an approval by the time of my current H1 expiry in December, will I be out of status?

My application was filed in EB3 category and PD is current (has been since start of this year). I have an approved I-140 since Feb 07 and the I-485 was filed prior to the mess of 2007. I have taken 4 Infopass appointments trying to find out why is it taking this long to get "a decision". At this point, I don't care what the decision is, as long as there is one so that I can move on in my life. Called and spoke with the processing center that the case is outside their "normal processing time" only to hear, "We are processing". They won't tell me what is going on.
Wondering about my options here? Congressional inquiry? Writ of Mandamus? Anything? Anyone in the same position as me?

I'm on H1 on 8th Year Extension,Got a nice offer from a company, which is not large company, but projects they have are very long term projects I applied for 485 long timeback, but did not applied for my spouse , who is on H4 , applied for H1 which will be validated from 1st Oct'06.Can I switch the company now and start using EAD and apply for my spouse when my PD becomes current , or wait with the current employer till I apply for 485.
Need SUggestion.

Can I ask new company to start new GC Process under Perm and apply for I-140 and once its get approved, Use My EB3 PD with the EB2 Perm Application.
Or
Can I use H1 Transfer and AC-21 option since my 8th year extension is till end of 2009.
