Something new I'm starting. USCIS puts out weekly data on the use of H-1B visas for the 2011 fiscal year which starts in October. I'm going to monitor that for readers and add my own projection on the months the caps are likely to be hit. Tough talk from the Senate Majority Leader. Some, including my good friend Tamar Jacoby, think this is a really bad idea. I'm not so sure. I think fear of losing the Hispanic vote for a generation or more and the sudden urgency of the situation created by the Arizona fiasco could make responsible Republicans at least seek to block a filibuster and allow for a majority vote (as seems likely with financial regulatory reform). But Tamar is right that we'll get a better bill if pro-business Republicans play a role since some of the overreaching protectionist efforts of the unions...

Dear all,
Myself and my husband both have approved I-797 for H1B from different US companies.
I went for my stamping to US embassy and they asked for more evidence regarding the US company and my case is currently pending with them with all my documents ( passport, I797, marriage certificate, etc).
Now my US company is not able to get a job letter for me.
Meanwhile my husband is planning to go for his stamping. He has good evidence to support his case.
My questions are -
1.) How can I retrieve all my documents from US embassy without affecting my passport and my H1 case?
2.) If I am able to retrieve all the documents safely, can I apply for H4 with my husband`s H1 stamping?
3.) Will they create problem for issuing H4 to me because of my pending H1b case?
4.) With H4 visa and I-797 approval notice, can I start working in US ?
5.) What will be the best way out of this situation without affecting our working visas ?
Please reply if you know anything.

Guys. Is this 7% country limit a hard or soft one ?. Assuming 1,40,000 total immigrant visas, India would get 7% of it and that is 9800. Then you have the preference category. Assuming there are unused immigrant visas from other countries, how do they get allocated ?. Does anyone has clear idea ?.

what is the right address to submit the I485 / EAD and AP using Fedex and fill it in Nebraska?
My attorney submitted my paperwork to:
850 S Street POBOX 87845 ?
I'm confused becase in the CIS site give the address in parentesis mention to write down the right POBOX.
What if she maid a mistake and send the paperwork to POBOX 87485?

I will be in DC, and we have rented a bus departing from wallace NC monday at 12:00hrs I still have sits available, we will drive to rRaleigh, the Virginia then DC

I got laid-off in Jan'09 and was not able to get a job. I returned back to India on 01-May-2009. I would like to come back to US since the economy is coming-up. Below is my situation:
Filed I-485 and it is in Pending status (Priority Date is May-2007). I-140 approved in Jan 2008.
Renewed EAD which is valid till July 2010. But AP got expired by 15-July-2009.
6 years of H1B expired by 31-May-2009.
1. What are my options now to come back to US?
2. When can I file for my new H1B? I heard there should be 1 year gap between H1B.
3. Will I be considered in regular quota OR I will get H1B on previously held quota?
Your suggestion will greatly help. Appreciate it.

My friend is an F1 student (citizen of India) who has been in the US for 3 years as a grad student. She has paid US taxes on stipend/fellowship received from US university while pursuing grad studies (filing taxes as a non resident in US, since the first 5 years on F1 are not counted towards substantial presence test).
Does she need to also pay taxes on this stipend in india, or report this income in india? AFAIK, no taxes need to be paid in India on this US stipend, but I couldnt find any authoritative reference online.
Am asking, since someone I know recently got a letter from IT dept in india saying that the US authorities reported $10K of income when that person was a student (this was a fellowship from the university) - and the letter goes on to ask the person to meet someone at the indian IT department.
