You are only counted against the quota once for a 6 year period , so I believe, she won't come under the quota , although it's getting harder to get H1B extensions every day

If economy rebounds by summertime itself, it means less pressure on immigrants from anti immigrant lobby and govt. Govt will be more inclined to grant GCs to immigrants.

I have filed two I485 application for the same company. One I485 got approved(also received the Green card) in Oct and another got denied today.

I was recently on H1B and renewal/extension was denied. So I left promptly to go back to Canada to establish residence there and start working. Now I need to return to the USA to retrieve some personal belongings, wrap up my residence and bring a car back etc...
My question is, when I enter the USA for the first time after being denied H1B will I have a hard time and will they be reluctant for some reason to permit me to enter as a visitor? I can't see why they would but who knows???
My family is still in the US and I need to help to get them prepared to come back

I am working for company A on H1 which is valid until November 2010. I would like to work for Company B on EAD, since company B would not do H1
To be on the safer side, I would to like have another H1 from company C, so that if anything happens with I-485, I can join company C on the H1.
Is this possible? Do I have to travel out of country in order to work for company C on H1?
In some of the forums I saw that, we can go to H1 from EAD as long as our H1B is unexpired. Pls let me know what you know about this.

Hi,
I have applied for my I140 under EB2, I have a question regarding a gab between my employments. I worked for a company A from Dec 2005 to Feb 2007 and then I switched employers, and I was between projects. The next company I started working for gave me an offer letter only when I found a project (May 2007). So technically there is a 2 month gap. Even the experience letters from that company says I have started work from May 2007.
I'm not sure if this will cause a problem in my I140 stage. Kindly advice.
I have changed two companies after that and I'm filing my GC through the current company. Any response will be much appreciated.

I had a question about using using AC21.
Here is the scenario: Let us say I work for XYZ Brothers who applied for my 140 and 485. I have approved 140, H-1b, EAD and AP.
If XYZ laid me off or I left them for career progression or more money 180 days after my 485 was filed and 140 approved what happens to my 485 application?
Wouldnt USCIS question that since my sponsoring employer does not exist anymore, who am I going to work for once I get my green card? or is this coverd under AC21?
Please advice!
