Hi,
I'm in H1b since March 2006 and it Expired in March 2009. Got extension Until Sept 2009 Only (as per RFE and client information).
( I'm about to deliver a baby in Oct 2009, so I need to be in the country atleast until Dec 2009)
1) If my further extension were to be denied (touch wood), say that decision was made by USCIS in Nov 2009,
Can I do COS ( change of status) to F2 or B2 visitor once I came to know about the denial?
or
Do I need to initiate a COS when the case is pending?
or
Do I need to initiate a COS when I have a valid status, say in Aug 2009 itself?
2) Assuming, I do COS successfully from H1b to F1 ( say in Oct 2009)
Then, in Feb 2010 would I be able to get back to H1 again with the same or different employer? without needing to wait for Apr 2010 quota to open?
3) Also, when a H1b is denied does it mean that the person has to wait to get into another cap? or
can they still apply for H1b year round as they are already counted in Cap sometime before?

USCIS updated its count of FY2011 cap-subject H-1B petitions and advanced degree cap-exempt petitions receipted. As of 8/20/10, approximately 33,900 H-1B cap-subject petitions were receipted. USCIS has receipted 12,600 H-1B petitions for aliens with advanced degrees. This is a major jump from the last update of August 13, 2010 where only 29,700 filings were reported.
Is this trend likely to continue? We think so, expect visas to run out by the early weeks of December.

Hello
I came to the U.S when i was 12 from germany on a vwp and have stayed here ever since i'm 21 years old now married to a U.S citizen, I have all the papers filled out ready to send to the USCIS for AOS thru marriage to a us citizen but our attorney has warned us that there has been recent denials in these types of cases Im very terrified and clueless i dont know if i should proceed and go for it or just wait and see if anything changes.
Please let me know if you or someone you know has gone thru this.

With its members gathered in her office, she told the House's "Progressive Caucus" that she would vote against the war funding bill, but that she also had no choice but to facilitate its passage. Funds were running out for the troops, and she had promised to protect them. The Memorial Day break loomed, and without the money President Bush would have a week to hammer her party for taking a vacation while the Pentagon scrambled to keep its soldiers fed.
Was she agonized over the situation? Sure, said Rep. Maurice D. Hinchey (D-N.Y.), who attended the meeting. But "we all feel that way," he added. "I feel that way, too. Are we going to just walk away now, or are we going to continue this process, to keep the pressure on?"
Yesterday's vote to fund the war through September was a historical rarity: the passage of a bill opposed by the speaker of the House and a majority of the speaker's party.
Two years ago to the day, then-Speaker J. Dennis Hastert (R-Ill.) violated the "Hastert rule" -- that only bills supported by a majority of the majority can come up -- by bringing up legislation to allow federal funding for stem cell research. The majority of the Republican majority opposed the law. He voted against it, but he knew it would never become law over President Bush's signature.
Over his objections and the opposition of most Republicans, Hastert did allow passage of campaign finance reform in 2002, but only because a petition drive was about to force the bill to the floor. The North American Free Trade Agreement passed in 1993, over the objections of most Democrats, who were then in the majority. But NAFTA did have the support of then-Speaker Thomas S. Foley (D-Wash.), as well as the Democratic president, Bill Clinton.
In contrast, the Iraq funding bill was not only opposed by the majority of House Democrats, it was also ardently opposed by the speaker and even the lawmaker who drafted it, Appropriations Committee Chairman David R. Obey (D-Wis.). And it is destined to become law.
"We don't relish bringing a package to the floor that we're not going to vote for," Obey conceded before last night's vote.
Pelosi's agonized decision put her in the company of Foley, who in 1991 brought to the floor the resolution authorizing the Persian Gulf War and then voted against it, and Thomas Brackett Reed, a speaker in the 1890s who voted against the annexation of Hawaii, and then against the Spanish-American War, but allowed both to go forward.
"To have the chairman and the speaker vote against a bill like this, I've never heard of it," Hastert said.
But while protesters outside the Capitol condemned what they saw as a capitulation, Democrats inside were remarkably understanding of their speaker's contortions.
Party leaders jury-rigged the votes yesterday to give all Democrats something to brag about. A parliamentary vote to bring the Iraq funding legislation to the floor included language demanding a showdown vote in September over further funding. A second vote allowed Democrats to vote in favor of funds for Gulf Coast hurricane recovery, agricultural drought relief and children's health insurance. Finally, the House got around to funding the war.
Republicans cried foul over what they saw as an abuse of the legislative system, but Democrats saw brilliance in the legerdemain. And with such contortions came more appreciation for the efforts Pelosi was making to fund the war in a fashion most palatable to angry Democrats.
"It was the responsible thing to do, and she's a responsible speaker," said Rep. Anna G. Eshoo (D-Calif.), who is personally close to Pelosi. "You can't just walk away."

Family migration is based around 2 general categories; one is based on a preference system and the other offers permanent residency regardless of the demand for Immigrant Visas. The latter, the Non-preference Category, is for immediate relatives of American citizens.
Fiancee's of American citizens will need to apply for a temporary non-immigrant K1 Visa if they wish to join their partner in America.

I used Ap in 2007 and than I filed H-1B extension 6 month prior to my H-1B expiring in sept 2008. which was approved with the sameI-94 as on parolee status.
I want to use AP again, is there any problem.

I was trying to find out if one can transfer from b1/b2 visa category to H1- B visa within the valid period of stay(i.e before the expiry of the I-94).
Go out of the country and come back in H1 status, provided you have a valid H1-B. (Can go to Canada also). Otherwise, too many hassles. (non-immigrant vs immigrant intent)

Hi,
I am going back to India by next week. But my L1B extension is still pending (We applied for ext., before it expired and recieved RFE and responded. So as of now its more then 6 months from the date of I-94 expired and still my petition is in process).
My question is,
- while going back, do I need to show the copy of reciept in Port of Entry? (as I need to return my I-94 which is expired long back)
- Will it create any problem when I apply for extension again?
(My employer say, it shouldn't be a problem as I will have Approved/Denial notice which prove that I maintained legal status)
Or is it worth to wait here until I get the decision? (as I may cross 240 days by Jan, I am not sure whether the decision will come before that)...
Please adivce.
